Introduction

As the UK’s only trade union specialising in construction, UCATT is at the forefront of negotiations concerning your pay, terms and conditions of employment with your employer in all the main agreements covering the construction industry.

The Construction Industry Joint Council agreement sets rates of pay for around 600,000 construction workers on the country’s major building and infrastructure sites. The agreement sets standards for the industry on pay and conditions. UCATT also represents members in a number of other allied trades to the construction industry such as Refractory Users and Steeplejack and Lightning Conductors and the Demolition Industry.

Construction Industry Joint Council - Holiday Pay

Building operatives employed under the terms and conditions of the CIJC Working Rule Agreement are entitled to 21 days annual holiday plus 8 public holidays. The Winter Holiday is 7 days taken in conjunction with Christmas day, Boxing day and New Year’s day; The Easter (Spring) Holiday is four working days immediately following Easter Monday; and The Summer Holiday is two calendar weeks, by mutual agreement with your employer and not necessarily consecutive, taken between 1 May and 31 October.

Holiday Year

The holiday year runs from the second Monday in January each year. Where employment commences after the start of the leave year the building operative will be entitled to the proportion of the 21 days annual holiday equivalent to the proportion of the leave year calculated from the first week of employment to the last week of the year. Holiday entitlements cannot be carried forward from one holiday year to the subsequent holiday year.

Payment for Annual Holiday

Where the operative’s pay does not vary with the amount of work done a week’s pay is the normal weekly wage for the contractual weekly hours as defined by the contract of employment.

Where earnings vary, because of piece work or productivity bonus arrangements, then a week’s pay is arrived at by calculating the earnings during the normal working week as defined by the contract of employment averaged over 12 complete weeks worked immediately prior to the holiday week.

Leavers

Building operatives who leave the employment of the employer during a leave year are entitled to a compensatory payment as follows:
(A ÷ 52) x 21 – B
Where A is the number of complete weeks of service in the leave year, and B is the number of days leave taken by the operative in the leave year excluding public/bank holidays.

Public Holidays

In addition to the industry holidays, building operatives are entitled to be paid for public holidays during their employment. Payment for public holidays is based on the normal earnings for that day as defined by the contract of employment and is based on an average of the previous 12 weeks earnings if earnings vary.
